Failure to pay rent is a breach of the tenancy agreement. If the tenant is in rent arrears within their first 6 months of tenancy, the landlord may serve a Notice of Termination without reason on the tenant. If the tenancy has lasted longer than 6 months, firstly, the landlord must serve a Warning Notice for the rent arrears giving the tenant 28 days to pay the outstanding rent. If there is continued failure to pay rent, the landlord may follow with a 28-day Notice of Termination of the tenancy agreement.
