OMC's - Block Management - Multi unit
An Owners’ Management Company (OMC) cannot impose fines or financial penalties on residents or unit owners for non-compliance with house rules—unless there is clear legal authority to do so, such as a specific provision in the lease or title documents.
Under the Multi-Unit Developments Act 2011, OMCs can set and enforce house rules, but enforcement typically involves warnings, mediation, or legal action—not fines. Attempting to impose fines without proper legal backing could be challenged and may not be enforceable in court.
If persistent non-compliance is an issue, the OMC may need to seek legal remedies, such as applying to the courts or the Residential Tenancies Board (if tenants are involved), depending on the situation. It’s essential for OMCs to act within their legal limits and seek legal advice before introducing or enforcing any form of penalty.
