How we handle car parking queries ?

In a Multi-Unit Development (MUD), car parking arrangements can vary depending on the title structure and the development’s governing documents. Here’s how to approach car parking queries effectively:

  1. Check the title and lease documents:
    First, determine whether parking spaces are:
    • Demised (legally assigned) to specific units in the lease or title documents
    • Allocated under licence (a permission to use, not ownership)
    • Common or shared spaces managed by the Owners’ Management Company (OMC)
  2. Review the House Rules or OMC policies:
    If the parking is managed by the OMC, there may be House Rules in place that regulate use, such as:
    • Assigned spaces or zones
    • Restrictions on commercial vehicles or visitor parking
    • Use of parking permits or access controls
  3. Direct the query to the right party:
    • If the space is demised to a unit, the owner or landlord of that unit is responsible.
    • For general or visitor parking, the OMC or property managing agent usually handles enforcement and complaints.
  4. Enforcement and disputes:
    The OMC may have authority to enforce parking rules through signage, access control systems, or by issuing warnings. However, legal enforcement (e.g. clamping or towing) must comply with relevant legislation, such as the Vehicle Clamping Act 2015.
  5. Communication and transparency:
    Clear signage and consistent communication with residents can help reduce confusion. If rules change, the OMC should notify all residents and update House Rules accordingly.

If in doubt, consult the MUD’s governing documents, your solicitor, or the property managing agent to clarify rights and responsibilities related to parking.
