OMC's - Block Management - Multi unit
Yes, an Owners’ Management Company (OMC) can modify the rules of a development, but there is a formal process that must be followed, in line with the Multi-Unit Developments Act 2011.
Any changes to the house rules or the constitution of the OMC must be proposed, usually by the board or directors, and then approved by a majority of members (i.e., the unit owners) at a general meeting. The proposed rules must also comply with the development’s governing documents and relevant legislation.
Changes cannot be arbitrary—they must be reasonable, clearly communicated, and in the best interests of the development and its residents. If passed, the new or amended rules become enforceable for all residents and owners.
Legal advice is often recommended when drafting or changing rules to ensure compliance and avoid future disputes.
